Newsmax ‘Walking Lawsuit’ Ed Henry Complains He Was A Federal Target

An Octr 29 Newsmax article features a complaint by one of its correspondents:

Newsmax host Ed Henry said the Biden Justice Department and special counsel Jack Smith targeted him as part of the “Arctic Frost” investigation — secretly obtaining his records over a charity song he co-produced with President Donald Trump and the J6 Prison Choir titled, “Justice for All.”

Appearing on “Greg Kelly Reports,” Henry said he only recently learned that federal investigators under Smith had obtained private information about him, including records from Apple Music, without his knowledge or any court notification.

“Jack Smith thought that Donald Trump was pocketing money here,” Henry told host Greg Kelly. “Based on the emails we’re now learning — Sen. [Chuck] Grassley gets the credit.

“He’s got whistleblowers.”

Henry said the government’s surveillance was premised on an accusation that he had personally profited from the song through a limited liability company — a charge he denies.

“They said [Henry] set up an LLC to get the royalties, which again went to Kash Patel’s nonprofit and then to J6 families,” Henry said. “But let’s dig into the LLC, let’s get the bank records — that was their approach.”

In fact, there is plenty of evidence Henry had a role in producing that record. An April 2023 Associated Press article states that Henry “, is listed as a director of the organization” behind “Justice For All,” and he is credited with being a producer of the slong, alongside now-FBI director Kash Patel. The AP added: “A spokeswoman for Patel and Henry declined to respond to questions about the song or the irony in using it in such a way.” It’s unclear what, exactly, Henry is denying here.

Unmentioned is the fact that the J6 Prison Choir is made up of suspected or actual criminals. The AP detailed that one choir member, Timothy Hale-Cusanelli, is now serving four years in prison for his actions during the Capitol riot after being convicted of felony obstruction of an official proceeding and four related misdemeanors. He was an Army reservist who sometimes styled his mustache like Hitler and who alarmed coworkers with his comments about women and Jews.

Henry went on to complain that he “never got a subpoena” over the investigation, insisting that “As an American citizen, you’re owed that.” He offered no evidence that any investigation target is “owed” notice of investigation.

You might remember that Henry was fired by Fox News in 2020 over allegations of sexual harassment, then later tried to sue anyone who reported on it. A few years later, he got fired from the far-right channel Real America’s Voice after a DUI arrest (his passenger at the time of the arrest just so happened to be Henry’s co-host, Karyn Turk). Even other Newsmax staffers were outraged that their employer would consider hiring Henry, calling him a “walking lawsuit.”
